What To Do If You Think You May Have A Qui Tam Case
If you are aware of any person, corporation or entity that you think may be violating the Federal False Claims Act or a State False Claims Act, you should contact an attorney who can assist you in evaluating your potential claim.
Be careful not to discuss the matter with anyone other than an attorney. A potential relator can face a number of major obstacles to recovery, including, but not limited to:
- Public Disclosure Rule - If the allegations are somehow disclosed before a relator files suit, he or she could be precluded from any recovery;
- First to File Rule – Only the first relator to file a claim has the ability to share in the recovery. A subsequent relator may be precluded, even if he or she had equal or superior knowledge than the first relator;
- Statute of Limitations – The statute of limitations for filing a case under the Federal False Claims Act may be as short as six years. State False Claims Acts also can have different statutes of limitation. A statute of limitations is important because it establishes how far back in time a potential relator and the government may go in pursuing allegations of fraud.
