Whistleblower Case Against OtterBox To Settle

A False Claims Act case filed in federal district court in Denver by a former employee against OtterBox nears settlement. The Fort Collins-based company has until the end of February to finalize a deal. The whistleblower, who worked as OtterBox’s supply chain director, alleged in his lawsuit that the company failed to pay customs duties on the full value of its popular cellphone cases. In response to the parties’ request for more time to settle the case, the federal court stayed the case until March 3, 2014, and ordered the parties to notify the court of the status of the case by February 28^th. Any settlement must be approved by the U.S. Department of Homeland Security, the Department of Justice, and the U.S. Attorney’s Office.
